Participation Restrictions

For safety reasons, individuals who have suffered a serious injury or undergone surgery within the last six months are not allowed to participate in our activities. Likewise, our activities are not suitable for pregnant individuals.

By reading and accepting these terms, you confirm that you do not fall into any of the above-mentioned categories.

Booking and Payments

​

To confirm a booking, a 50% deposit of the total service cost is required. The remaining 50% must be paid on the day of the event, before the start of the activity.

​

The deposit can be paid in one of the following ways:

    •    Through our website during the booking process

    •    Via bank transfer to the account provided upon request

Once we receive your deposit, you will receive a written confirmation including all event details.

Cancellation Policy

​

Once a booking is confirmed, no refunds will be issued under any circumstances. We understand that unexpected situations may arise, but due to the nature of our services and the planning involved, we are unable to offer refunds for any payments made.

The only exception to this policy is in the case of a serious injury that prevents participation. To request a refund in such cases, a valid medical certificate must be provided, and the refund will be subject to verification of the medical documentation.

Additionally, once the booking is made, changes to the date or time of the activity will not be allowed. We recommend checking your availability carefully before confirming your reservation to avoid any inconvenience.

This policy is in place to ensure a high-quality experience for all clients and to allow for proper organization of our events. We appreciate your understanding and cooperation.

Provider Modifications

​​

Excel Activity Group reserves the right to modify or cancel any booking due to circumstances beyond our control, such as adverse weather, emergencies, safety concerns, and more. We also reserve the right to cancel or modify an activity if the safety of participants cannot be guaranteed due to human or natural factors.

These circumstances include, but are not limited to:

    •    Strong winds

    •    Heavy rain or flooding

    •    Natural disasters

    •    Fires

    •    Terrorism

    •    Strikes

    •    Unexpected construction

    •    Vehicle breakdowns

    •    War or armed conflicts

    •    Unavoidable absences

We also reserve the right to cancel or modify the activity on the same day of the event if our team deems it unsafe to proceed.

In any of the above cases, no refunds will be issued.

Client Responsibilities

Clients must follow all rules and instructions provided by the Excel Activity Group team before and during the activity. Safety instructions must be strictly followed at all times.

​​

Our team reserves the right to stop the activity at any time if participants are not following the rules or using the provided equipment improperly. If any equipment is damaged, broken, or lost due to misuse, the client will be responsible for covering the replacement or repair costs.

​​

Additionally, the client will be liable for any damages caused to the venue during the activity.

​​

These measures are in place to ensure a safe and enjoyable experience for everyone involved.

Liability Disclaimer

​

All activities offered by Excel Activity Group involve physical contact and therefore carry an inherent risk of injury.

​​

By participating, clients acknowledge and voluntarily accept all risks associated with the activities. These risks include, but are not limited to:

    •    Slips

    •    Falls

    •    Contact or collisions with staff

    •    Contact or collisions with other participants

    •    Contact with natural or artificial objects

Clients understand that these risks may result in physical harm, ranging from minor to severe injuries, and that these may result from their own actions, the actions of others, or other unpredictable factors.

By joining our activities, clients assume full responsibility for any damage, liability, loss, or expense that may result from their participation.

Data Privacy and Protection

At Excel Activity Group, we are committed to protecting the confidentiality and privacy of our clients in compliance with applicable data protection laws. All personal information provided by the client will be treated confidentially and will not be shared with third parties without prior consent.

We will only disclose client data in exceptional situations, such as medical emergencies, where it is necessary to protect the client’s or others’ health or safety. In such cases, data will be shared only with the relevant authorities or medical services.

By accepting these terms, the client gives consent for the processing of their personal data in accordance with our privacy policies.

Image Rights

​

By agreeing to these terms, the client gives consent for Excel Activity Group to take photographs and record videos during the activities. We reserve the right to use this media for any legitimate purpose, including promotional, advertising, and marketing uses.

The client also agrees that Excel Activity Group may use, market, and profit from such photos, videos, and similar recordings, without the obligation to provide compensation.

Applicable Law and Jurisdiction

 

These terms and conditions shall be governed by and interpreted in accordance with the laws of Spain. Any dispute or claim relating to the interpretation, enforcement, or performance of these terms shall be subject to the jurisdiction of the courts of Málaga, with both parties expressly waiving any other jurisdiction that may apply.
